Nice classification — overview and selection.

WIPO NCL · 12th edition
34 goods + 11 services

The Nice classification organises goods and services into 34 goods classes (1–34) and 11 service classes (35–45). It is administered by WIPO; the current edition is NCL-12-2024. Choosing the right class shapes both the protection scope and the filing fees.

Class strategy for SaaS startups (typical Marqio profile)

  1. Class 9 for software delivered as a file, download or on-premise install.
  2. Class 42 for software-as-a-service and cloud services.
  3. Class 35 if the platform contains an e-commerce or marketplace element.
  4. Class 38 if real-time communication is a core feature.
  5. Class 41 for pure education or content platforms.

Default UI recommendation: Class 9 + 42 as a pair, optionally with 35. Rationale: covers the SaaS use case in most configurations.

Choosing Nice classes is a substantive decision with consequences for protection scope and filing fees. Marqio provides a recommendation, not legal advice — the final selection rests with the applicant or their counsel.
